Terms and Conditions

Online sales can be traced back to mail order sales and therefore without the obligation of an invoice as provided for in Article 22 of Presidential Decree 633 of 1972, and without the obligation to issue a receipt as provided for in Article 2, letter oo), of Presidential Decree 21 December 1996, n. 696.

1) DEFINITIONS

The expression “online sales contract” means the purchase and sale contract relating to the tangible movable assets of DIENNE S.R.L., stipulated between DIENNE S.R.L. and the Buyer as part of a distance selling system via telematic tools. The expression “Buyer” means the consumer, a natural person who makes the purchase referred to in this contract, for purposes not related to any commercial or professional activity carried out. The expression “stochosell.com” means the website through which DIENNE S.R.L. sells the goods covered by this contract.

2) IDENTIFICATION AND OBLIGATIONS OF THE PARTIES

Supplier: The goods covered by these general conditions are offered for sale directly by DIENNE S.R.L., Via Antonio Gramsci 7, 67051 Avezzano (AQ), Italia, P.IVA IT01755060660, which is the sole seller responsible for the sale of the goods. Buyer: Expressly declares to make the purchase for purposes unrelated to any commercial or professional activity carried out, and undertakes not to trade in what has been purchased.

3) OBJECT AND CONCLUSION OF THE CONTRACT

With this contract, DIENNE S.R.L. sells and the Buyer purchases remotely via telematic tools the tangible movable goods indicated and offered for sale on stochosell.com. The contract is concluded exclusively through the internet, by the Buyer accessing the site and, following the procedures indicated, formalizing the purchase proposal. The purchase contract is concluded through an irrevocable order by the Buyer, completed via the online order form, which displays the order details, the price of the purchased good, shipping costs, payment method, and delivery address. Upon receiving the order, DIENNE S.R.L. will send a confirmation email summarizing the order. If requested, the sales invoice will be issued by DIENNE S.R.L. in electronic format.

4) PAYMENT AND REFUND METHODS

DIENNE S.R.L. accepts the following payment method: Cash on delivery. Any refund due to the Buyer will be issued via bank transfer to the account provided by the Buyer, within 7–14 working days from the date on which DIENNE S.R.L. became aware of the cause generating the right to reimbursement.

5) DELIVERY TIMES AND METHODS

DIENNE S.R.L. will deliver the products ordered via trusted courier services. Products are shipped with appropriate packaging. If a package arrives torn or damaged, please check the integrity of the product and immediately report the damage to DIENNE S.R.L.’s customer service.

Order processing times may vary, from the day of the order to a maximum of 40 working days, within which the product will be delivered. If DIENNE S.R.L. is unable to ship within this deadline, the Buyer will be promptly notified via email, with an updated estimated delivery date. Delivery times may vary depending on the destination country and other factors outside the Supplier’s control.

6) SHIPPING AND DELIVERY COSTS

Shipping is free for all orders. For deliveries outside the EU, the courier may present a separate invoice for local duties and taxes required by local authorities; Buyers residing outside the EU are advised to check applicable local taxes and duties before placing an order.

Delivery will be made to the ground floor / street entrance and not carried to individual floors.

Upon receiving the goods it is necessary to check:

• that the number of packages delivered corresponds to the transport document;
• that the packaging is intact and unaltered, including the sealing tape.

NB: The customer is required to sign the consignment note only if the packaging is intact. In the event of visible external damage or suspected tampering, it is necessary to refuse the goods or accept them with reservation, noting the damage on the consignment note before signing.

7) AVAILABILITY OF PRODUCTS

DIENNE S.R.L. ensures the prompt processing and fulfillment of orders. If an order exceeds the quantity available in the warehouse, DIENNE S.R.L. will inform the Buyer via email whether the goods are no longer available or what the expected waiting time is, and will ask the Buyer whether they wish to confirm or cancel the order.

8) LIMITATIONS OF LIABILITY

DIENNE S.R.L. assumes no responsibility for delays or disservices attributable to force majeure. DIENNE S.R.L. is not liable to the Buyer, except in cases of willful misconduct or gross negligence, for malfunctions connected to the use of the internet network beyond its control or that of its sub-providers. DIENNE S.R.L. is not responsible for damages, losses, or costs suffered by the Buyer due to failure to execute the contract for reasons not attributable to DIENNE S.R.L., the Buyer being entitled only to a full refund of the price paid.

9) LIABILITY FOR DEFECTS, PROOF OF DAMAGE, AND COMPENSABLE DAMAGES

No compensation will be due if the injured party was aware of the product defect and the resulting risk, and nevertheless voluntarily exposed themselves to it. The injured party must prove the defect, the damage, and the causal connection between the two. Compensation may be claimed for damages resulting from death, personal injury, or destruction/deterioration of goods normally intended for private use. DIENNE S.R.L. assumes no responsibility for disservices attributable to force majeure (accidents, explosions, fires, strikes, earthquakes, floods, and similar events) that prevent, wholly or partly, the execution of the sales agreement within the agreed times.

10) BUYER’S OBLIGATIONS

The Buyer undertakes to pay the price of the purchased good according to the terms indicated in the Contract, and to retain the order confirmation page. The information contained in this contract is considered viewed and accepted by the Buyer at the time of finalizing the order.

11) RIGHT OF WITHDRAWAL

Pursuant to the Italian Consumer Code (Legislative Decree 206/2005, as amended, implementing Directive 2011/83/EU), the Buyer has the right to withdraw from the contract, without penalty and without specifying a reason, within 14 days of receiving the goods, by notifying DIENNE S.R.L. via email at info@stochosell.com. If the goods have already been delivered, the right of withdrawal is exercised by sending, within 14 days from the day of receipt, written notice to DIENNE S.R.L. containing the order details and the clear intention to withdraw. The product must not have been used and must be returned in its original packaging, together with a copy of the purchase document.

12) GOODS EXCHANGE

DIENNE S.R.L. grants the Buyer the right to exchange goods for the same item. To request an exchange, the Buyer must send an email to info@stochosell.com within 14 working days of receipt, indicating the item code(s) to be exchanged. DIENNE S.R.L.’s customer service will send a written confirmation with an authorization number, which must be indicated on the return package label. Return shipping costs for exchanges are borne by the Buyer. DIENNE S.R.L. reserves the right to request photographic evidence before authorizing returns or exchanges of products claimed to be defective. We do not accept exchanges or returns of products that have been tampered with or altered, or of custom-made items.

13) PROTECTION OF CONFIDENTIALITY AND PROCESSING OF BUYER’S DATA

DIENNE S.R.L. protects the privacy of its Buyers and guarantees that data processing complies with Regulation (EU) 2016/679 (GDPR) and applicable Italian law. Personal and fiscal data collected directly by DIENNE S.R.L., as Data Controller, are processed in paper, electronic, and telematic form for the purposes of order fulfillment, contract execution, related communications, and compliance with legal obligations. DIENNE S.R.L. undertakes to treat Buyer data confidentially and not to disclose it to unauthorized parties or use it for purposes other than those for which it was collected, except upon request of judicial or other authorities as required by law. Under Articles 15–22 of the GDPR, the Buyer has the right to access, rectify, erase, or restrict the processing of their data, to object to processing (including for marketing purposes), and to request data portability. These rights may be exercised by contacting DIENNE S.R.L. at info@stochosell.com. Data will be retained only for as long as necessary for the purposes for which it was collected.

14) COMMUNICATIONS AND COMPLAINTS

Pursuant to Art. 12 of Legislative Decree 70/03, DIENNE S.R.L. informs the Buyer that each order sent is stored digitally on the server hosting the site, in accordance with confidentiality and security standards.

15) CONTRACT STORAGE METHODS

Written communications and complaints directed to DIENNE S.R.L. will be considered valid only if sent to: info@stochosell.com.

The Buyer indicates, in the registration/order form, the address, phone number, or email to which communications from DIENNE S.R.L. should be sent.

16) DURATION AND EFFECTIVENESS OF THE CONTRACTUAL CONDITIONS

Confirmation of the order implies acceptance of these general conditions by the Buyer. These conditions may be updated at any time via publication of the revised version on this site. Changes will apply only to orders placed after the update, and not to orders for which the order confirmation page has already been displayed.
